The purpose of this “use policy” is to assure the renters and the management of their requirements and responsibilities.
The Merced Theatre
consists of an upstairs lobby with restrooms, downstairs lobby with restrooms,
concession stand, ticket booth, theatre seating for approximately 300 people,
450 square foot stage, and marquee lighting.

APPLICATION
PROCEDURES:
a)
All applicants
are required to complete an application.
Applications must be approved by the Merced Theatre Foundation. All
renters must pay a $100.00 non-refundable deposit at the time of approval of
application to hold a date, with the remainder of rental fees due two weeks
prior to the event. If all rental fees
and deposits are not paid by the date due, the event is subject to cancellation.
b)
A $250.00
security/cleaning deposit is required and due two weeks prior to the
event. The deposit will be fully
refunded within 30 days if the area rented is returned in the same condition as
received. Should the area rented require
cleaning or replacement of damaged items, these fees will be deducted from the
security deposit. Should the deposit not
be sufficient, renter is liable for additional costs.
c)
No smoking or
use of any tobacco of any kind is permitted.
No open flames (i.e. candles) are allowed pursuant to State Fire Marshall
codes.
d)
Hours of
operation will be 9:00 a.m. – 11:00 p.m.
The Theatre is locked by 12:00 a.m. with no exceptions. It is the renter’s responsibility to clean up
all food, beverages, decorations, trash, etc., and to remove such items from
the facility. All trash is to be removed
and placed in trash receptacle outside the building.
e)
Prior approval
of management is required for alcoholic beverage service. No alcoholic beverages are to be served for
any youth oriented event. Renter is
responsible for obtaining any permits or licensing required to serve alcoholic
beverages. No illegal activity is
allowed on premises. Merced Theatre
Foundation retains the right to cancel contract should any illegal activity
occur.
f)
All equipment,
supplies, etc. must be removed from the facility immediately following the
event. The Merced Theatre Foundation
reserves the right to remove all remaining articles from premises and have them
stored at the owner’s expense. Should
such equipment or supplies not be claimed within 6 weeks, the Theatre
Foundation reserves the right of said equipment and will dispose of, as
necessary.
g)
Any signs or
decorations to be attached by tape. No
nails or tacks to be used on walls.
Decorations must be fire resistant.
h)
Rental of the
concession stand does not include use of the popcorn machine, soda dispensers
or Merced Theatre concession supplies.
i)
Use of the
marquee to announce an event or other related information is included in the
rental cost of the Theatre and lobbies.
Rental events will be listed on one marquee side panel, just prior to
the event. The length of marquee wording
is limited to three lines and subject to letter availability. The marquee may be rented to display a
message separate from a rental event (non-commercial use only) for
$100/week. All marquee wording is
subject to approval by the Merced Theatre Foundation.
j)
Renters may be
allowed access to the building one day prior to their event for setup if the
facility is not rented and available.
Setup of the event is not included in the rental time. One hour after the event is allowed for clean
up. This is not included in the rental
time. Any other arrangements to be
approved by the Merced Theatre Foundation.
k)
Security will
be required for some events at a ratio of 1 security guard per 100 people. Renters must retain the services of a
licensed security firm approved by the local police department with a copy of
the certificate of security provided to Merced Theatre Foundation two weeks
prior to the event. Security shall be in
place at time of commencement of gathering with no exceptions. Should security not be in place at
commencement of gathering, we retain the right to cancel or withhold entry
until such adequate security is in place.
Request for waiver of this requirement will be considered on an
individual basis.
l)
LIABILITY
INSURANCE: Renters of the facility shall
procure and maintain, at their own expense and for duration of the event
concerned, comprehensive general liability and property damage insurance,
against all claims for injury against persons and damage to property, which may
arise for, or is connected with the use of the facility by the renter, its
agents, representatives or employees, in the amount of $1,000,000. Proof of insurance shall be provided to the
Merced Theatre Foundation and is due two weeks prior to the event. General liability insurance shall name
the Merced Theatre Foundation, Inc. as additional insured regarding all
activities held at the Merced Theatre during, prior to and after the event of
which the facility is rented. If liquor
is to be served, liquor liability insurance in the amount of $1,000,000 is
required and must be shown on the certificate of insurance.
